Our Terms and Conditions Upon Booking

 

Upon receipt of your £20 deposit you will be sent a confirmation form which asks for the names and contact details of the participants (and their lawyers where applicable). Your return of that form to us within three working days is confirmation of your booking, a contract to make payment for the full amount within seven days of receipt of our invoice and any cancellation will trigger our cancellation fees.

Upon receipt of your confirmation of booking form, the participants (or their lawyers) will be sent our standard Mediation Agreement for signature by the participants, their advisors and any other persons who will be in attendance at the mediation. 

We can best help you when you are prompt in sending us the basic information in the confirmation of booking form we need to properly conduct your mediation. This includes details of the venue, some basic information about the dispute and all details of the participants so we can ensure there is no reason why Gayle is conflicted in acting as the mediator in your dispute.  

Bumps in the road

f we do not receive your confirmation of booking form within three working days, your date will be released and the £20 deposit fee will be kept as payment towards our admin costs. However the paying party will have the option to secure another date, even for another mediation, within the next six months. This is subject to availability. We hope you'll agree, that's fair.

We reserve the right to cancel confirmed bookings if we do not receive payment of our invoice within seven days of sending it to you. 

In the unlikely event Gayle is unable to act as mediator any fees, including the £20 deposit will be returned to you promptly. Of course, we're as flexible as we can be when there is communication. If there's a reason why you need extra time to deal with admin or payment, we're very likely to be accommodating. All we ask is that you are mindful that we're managing a busy schedule, we may need to arrange and book travel and accommodation and don't want to commit to those costs without a confirmed booking in the diary. 

In the unlikely event of Gayle's illness or other unforeseen circumstances, Camel Mediation Ltd's liability is limited to the participants costs of pre-paid travel, accommodation and venue hire of the aborted date. Another date will be arranged as soon as practicable for all parties involved. If preferred, the mediation can go ahead with another suitable mediator either chosen by me or the parties involved. As a member of the Society of Mediators and Association of Northern Mediators, it is highly likely Camel Mediation can arrange for the mediation to continues as planned with a substituted mediator.

We understand that even confirmed mediations need to be cancelled or postponed. That's why we have a transparent and competitive cancellation policy. If the mediation is cancelled, or the date moved, more than 28 days before the mediation date, then all monies paid, less the £20 deposit, will be returned.  

Between 28 days to the day of the mediation, we'll need to charge a portion of our fee for cancellation on a sliding scale which has factored in whether we are likely to have paid out for travel and accommodation costs in advance of your mediation and the loss of opportunity for securing other work. The closer we get to your mediation date the less chance there is to sell the date elsewhere and more work we will have done in reading the papers you have sent us, pre-mediation calls and even travel to the mediation venue. 

With an entitlement to 50% of fees paid even 7+ days before, we hope you agree this is very workable for all. It helps that Gayle is juggling work as a contentious probate solicitor and can offer flexibility. We've also been generous with our cancellation policy to promote resolution. A date in the diary can give the participants a fresh perspective without needing a mediation at all. As Wizard Oz said to Dorothy; "You don't need to be helped any longer. You've always had the power..."
