Half Day: What's included?
Up to 2 hours - document review
30 minutes (x2) - pre-mediation call with each party
Once you're all booked in, we'll meet for a pre-mediation call via zoom or telephone. Having this conversation prior to the mediation day allows us all to hit the ground running on the day. Calls usually begin with any legal representatives first for ten minutes to cover any more legal points and then you join. Sometimes the legal representatives stay, sometimes they leave. It's your choice.
Up to 4 hours mediation on your chosen day. That's a total of 7 hours dedicated to your dispute.
We can begin at any time that day to suit you and your legal representatives as long as we begin by 1pm. I recommend starting earlier than 1pm in case of overrun.
Full Day: What's included?
Up to 4 hours - document review
1.5 hours (x2) - pre-mediation call with each party, pre-mediation call with lawyers for each party.
Once you're all booked in, we'll meet for a pre-mediation call via zoom or telephone. Having this conversation prior to the mediation day allows us all to hit the ground running on the day.
Calls usually begin with any legal representatives first for thirty minutes to cover any more legal points and then you join. Sometimes the legal representatives stay, sometimes they leave. it's your choice.
Up to 8 hours - mediation on your chosen day. That's a total of fifteen hours dedicated to your dispute.
We can begin at any time between 8am - 10am to suit you and your legal representatives. I recommend starting earlier than 10am in case of overrun. If we are starting at 8 am, then the eight hours will expire at 4pm. If we are starting at 10am, then the eight hours will expire at 6pm.
If you wish me to do so, I will continue to act as your mediator after the expiry of eight hours on my overrun hourly rate. If we are to in-person-mediate past 9pm, an accommodation fee capped at £100 will apply. I cannot guarantee that I will be able to mediate past 9pm, but most times this will not cause an issue, especially if mediating online.
Hump Day Wednesday: What's included?
Hump Day Wednesdays are specially reserved for those who might otherwise struggle to fund the costs of a mediation. They are for two participant mediations and delivered remotely by Zoom only.
Eligibility:
To be eligible, you must be coming to mediation to explore settlement of your dispute in one of the following set of circumstances:
a) You have a monetary dispute on an Estate valued at less than £250,000; OR
b) the particular part of the Estate you wish to try and resolve must be worth less than £250,000 and we’re leaving the rest of the Estate for another day; OR
c) You have a non-monetary issue dispute on matters such as which care home to choose, where /whether to bury or cremate, who will be appointed executor, who will take over MD role in the family business, who will take over ownership of a family pet. Disputes like this are emotionally challenging and every bit as hard to unravel as a high value monetary claim. Often solving this type of dispute first can pave the way for then dealing with the monetary dispute next.
How we manage the 6 hours of mediation for a set fixed fee of £250 per party (total £500):
In the unlikely event of my illness or other unforeseen circumstances, my liability upon cancellation is limited to the parties costs of pre-paid travel, accommodation and venue hire of the aborted date. Another date will be arranged as soon as practicable for all parties involved. If preferred, in such unforeseen circumstances, I will usually be able to substitute myself with another suitable mediator to ensure the mediation continues as planned.
